Law 10113 was approved on March 2, 2022. Its official title is “Ley del cannabis para uso medicinal y terapéutico y del cáñamo para uso alimentario e industrial”.
Two authorized uses
- Cannabis, including psychoactive cannabis: for medical and therapeutic purposes only.
- Hemp (non-psychoactive cannabis): for food and industrial purposes.
Two ministries
MAG and the Ministerio de Salud each control the activities in their own area (article 4). In broad terms, MAG handles cultivation and production, and Health handles products and their dispensing.
The boundary
Measures against activity that exceeds or breaks the authorized parameters fall outside the law and are handled under other laws, including the General Health Law and Law 8204 (article 3).
