The law treats hemp, or non-psychoactive cannabis, separately from psychoactive cannabis. It allows the cultivation, production, industrialization, transport, distribution and commercialization of hemp and its products, subject to prior special authorization from the competent authority, plus the permits that any agricultural or agro-industrial activity needs (Law 10113, article 5).
- MAG is the authority for hemp cultivation and production authorizations.
- Per the Ministerio de Salud (February 16, 2026), hemp authorizations are issued at no cost and are valid for six years, renewable if the rules are met.
- Requests can be filed through the digital one-stop investment window (VUI).
